1. Agreement to Terms

Welcome to Taroh ("we," "us," "our," or "the Service"). By accessing, browsing, interacting with, or purchasing services through Taroh, you ("Querent," "User," or "you") agree to be legally bound by these Terms of Service ("Terms") and our Legal Disclaimer. If you do not agree, you must cease using the Service immediately.

2. Eligibility & Age Restriction (18+)

You must be at least eighteen (18) years of age (or the legal age of majority in your jurisdiction) to access or use Taroh. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Purpose of Service & Non-Reliance

Taroh is a digital ritual object designed to facilitate introspective self-reflection and artistic delight using traditional tarot archetypes and generative artificial intelligence.

• Entertainment Only: Taroh does not provide supernatural predictions or factual claims regarding future events.
• No Professional Advice: Readings do NOT constitute medical, psychiatric, psychological, legal, tax, or investment advice. Do not rely upon readings for health, financial, legal, or life-altering choices.
• Crisis Situations: If you are experiencing thoughts of self-harm or a mental health emergency, please immediately call 988 or 911 (US/Canada), 188 (Brazil), or local emergency services.

4. Generative AI Interpretations

Portions of Taroh's readings (including customized passages under "The Silver Key") are synthesized dynamically by Google Gemini.

• Interpretations are generated probabilistically and may contain metaphorical, poetic, subjective, or inaccurate statements.
• AI-generated readings are produced automatically without prior human review or editorial endorsement.

5. Paid Services & Digital Goods Policy

Taroh provides both free features (such as standard card voices and daily draws) and paid offerings (such as "The Silver Key" for customized AI readings).

• Immediate Performance: When you purchase a reading pass, token, or membership, you request immediate digital execution and delivery.
• Refund Policy: Because personalized digital readings are synthesized and delivered instantaneously, all purchases of digital readings and memberships are final and non-refundable to the maximum extent permitted by applicable law.
• Payment Gateways: Commercial transactions are processed securely via third-party processors (e.g., Stripe). We do not collect or store full payment card details.

6. User Conduct and Input Prohibitions

When entering questions into Taroh, you agree NOT to:

• Input sensitive personal information (such as Social Insurance Numbers, Social Security Numbers, passwords, or financial account details);
• Submit prompts promoting self-harm, hate speech, violence, child exploitation, harassment, or illegal conduct;
• Attempt to scrape, reverse engineer, decompile, or bypass rate limits and durable counter mechanisms.

7. Intellectual Property

All visual designs, custom WebGL2 shaders, 3D card meshes, audio synthesizers, written card voices, trademarks, and code are the exclusive intellectual property of Taroh and its creators. You are granted a limited, personal, non-commercial license to use the Service for reflection and delight.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF GENERATED CONTENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TAROH OR ITS CREATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, EMOTIONAL DISTRESS, OR RELIANCE LOSSES) ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL BE STRICTLY LIMITED TO THE GREATER OF: (A) THE AMOUNT ACTUALLY PAID BY YOU TO TAROH IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR (B) FIFTY CANADIAN DOLLARS ($50.00 CAD).

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal dispute shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, and you agree to resolve disputes on an individual basis, waiving participation in class actions.
